يشهد المجال الطبي تطورات هائلة متلاحقة من خلال استخدام التكنولوجيا الحديثة بما تحتويه من أجهزة ومعدات متطورة و مختلفة قد يترتب عنها المساس بحقوق الأشخاص.

فالحق في الحياة و الصحة و السلامة الجسدية و تحريم المساس بها هي أهم الحقوق و الحريات المكفولة شرعا و قانونا، و أصبح تسخير كل الوسائل التكنولوجية المتطورة حماية للصحة العامة من ضروريات هذا العصر، غير أن استخدام التقنيات التكنولوجية في المجال الطبي  و ما أحدثته من تسهيلات في هذا المجال سواء بالنسبة للمرضى او الأطباء، خاصة ما تعلق باستخدام تقنيات الذكاء الاصطناعي، و ما قد ينتج عنه من المخاطر تمس بأحد هذه الحقوق.

و هو ما يستدعي تدخلا لحماية تلك الحقوق من المخاطر التي تنجم عن استخدام التقنيات الحديثة حيث شغل ذلك اهتمام العلماء والباحثين في هذا المجال  و بالخصوص تحديد المسؤولية القانونية الناجمة عن استخدام التقنيات الحديثة والذكاء الاصطناعي في المجالات الطبية.

Abstract

The medical field is witnessing rapid and significant developments through the use of modern technology, including advanced and diverse devices and equipment, which may result in the infringement of individuals’ rights.

The right to life, health, and physical integrity, as well as the prohibition of any violation thereof, constitute some of the most fundamental rights and freedoms guaranteed by both religious principles and legal systems. Harnessing advanced technological means to protect public health has become a necessity of the modern era. However, the use of technological innovations in the medical field—particularly artificial intelligence technologies—and the facilitation they provide for both patients and physicians may also give rise to risks that threaten these rights.

This situation calls for legal intervention to protect such rights from the risks arising from the use of modern technologies. Consequently, this issue has attracted the attention of scholars and researchers in this field, especially with regard to determining the legal liability resulting from the use of modern technologies and artificial intelligence in medical practice.
