يتناول هذا الكتاب ظاهرة القرصنة البحرية التي عادت من جديد، فيحاول المؤلف من خلاله تحديد مفهومها حسب العديد من الإجتهادات الفقهية والقانونية ضمن مجموعة من الوثائق الدولية، كما يوضح شروط قيامها وأشكالها، ويسلط الضوء كذلك على أركان جريمة القرصنة البحرية المتميزة بأركان إضافية مختلفة عن أركان الجرائم العادية المعروفة ، كما يشرح ويحلل طبيعتها والإختصاص القضائي

المعهود لها وشروطه لمعاقبة مرتكبيها ، وفي النهاية يبين المؤلف المعوقات المختلفة والمتعددة دوليا ووطنيا التي تحول دون معاقبة القراصنة البحريين، مع محاولة منه اقتراح مجموعة من الحلول الفكرية للتصدى لهذا الفعل الإجرامي وبتره من جذوره إن أمكن.

 Résumé

 Cet ouvrage traite le phénomène de la piraterie maritime, qui revient à nouveau, et tente de définir son concept, qui a été évoqué, par de nombreuses jurisprudences et interprétations juridiques  au sein d’un ensemble de documents internationaux, les conditions de ses actes et ses formes, ainsi que les conditions pour les punir, en abordant les divers et multiples obstacles au niveau international et national empêchant la punition de ces pirates marins, en essayant de proposer un ensemble de solutions en vue de faire face à cet acte criminel et de le couper de ses racines si possible.

Abstract

This work treats the phenomenon of maritime piracy, which returns again, and tries to define its concept, which was evoked, by many jurisprudences and légal interpretations within a set of international documents, the conditions of its acts and its forms, as well as the conditions for punishing them, then addressing the various and multiple obstacles at international and national level that prevent the punishment of these marine pirates, trying to propose a set of solutions with a view to dealing with this criminal act and to cut it from its roots if possible.
